1. What the TCPA Is
The Telephone Consumer Protection Act (TCPA) is a U.S. federal law that restricts certain telephone solicitations and the use of automated dialing systems, prerecorded messages, and text messages. Penalties for violations can be significant (commonly $500–$1,500 per violating call or text), so compliant outreach matters.
2. What We Do on Our Side
- DNC scrubbing. We screen our data against the National Do-Not-Call Registry and internal suppression lists as part of our verification process.
- Verification. The large majority of records are verified before they are made available to you.
- Business focus. Our data is intended for business-to-business outreach to business lines and business contacts.
3. Your Responsibilities
When you contact leads you purchase, you are responsible for:
- Maintaining and honoring your own internal Do-Not-Call list, and honoring any opt-out request promptly.
- Complying with the TCPA, the CAN-SPAM Act, state telemarketing and consent laws, and any relevant international rules.
- Obtaining any consent required for automated dialing, prerecorded messages, ringless voicemail, or text messaging before you use those channels.
- Calling only within permitted hours and identifying yourself and your business as required by law.
- Providing a clear, working opt-out mechanism in emails (as required by CAN-SPAM) and honoring unsubscribe requests.
4. Email (CAN-SPAM) Basics
- Don't use false or misleading header or subject lines.
- Identify the message as an advertisement where required.
- Include your valid physical postal address.
- Provide a clear way to opt out, and honor opt-outs within 10 business days.
5. Auto-Marketing Features
Where MakeLeads offers automated email, SMS, or ringless voicemail tools, those tools are provided to help you execute your campaigns. Using them does not transfer compliance responsibility to us. You remain responsible for having a lawful basis to contact each recipient through each channel you choose.
